Shams and Shambles


American inventor and businessman, Thomas A. Edison, once said, “Being busy does not always mean real work. The object of all work is production or accomplishment and to either of these ends there must be forethought, system, planning, intelligence and honest purpose as well as perspiration” and throughout the difficulties of keeping my family afloat while dealing with the aftermath of our financial demise I have, not unlike Edison, remained convinced that a satisfactory resolution to my Halifax Bank of Scotland complaint will only be forthcoming if I remain sufficiently focused on all that is necessary to accomplish the task at hand.

Committed to the pursuit of an intelligent solution to our predicament following the collapse of our property business (2008) and the forced sale of our home (2009) I have diligently, trawled for news of government rescue packages together with banking reforms and financial regulation which might aid my endeavours. With each and every letter I have written, I have increased my understanding of the ways in which huge organisations like the FSA, the FOS and HBOS are expected to operate and familiarised myself with the guidelines by which they are supposed to abide. The by product of this has been a much broader knowledge and a substantial helping of increased confidence.

Entering the beginning of my fifth year of battle, I remain hopeful that media interest, public outrage and my own refusal to be fobbed off by bully boy banksters and their regulators will eventually combine to affect a change which alters the way in which banks have so far been permitted to treat their victims. However, despite my best efforts and the pre Christmas promises of both HBOS and the FOS with regard to my over valuation complaint, I have to concede to date I have accomplished very little and even the past few weeks spent in hot pursuit of a hearing for my HBOS complaint have done nothing to change this.

Tempered in expectation as a result of HBOS’s past performance but, nonetheless, hopeful my long overdue request of almost year might have come to fruition by 2 January 2013 (as per the deadline HBOS set for themselves) I still remain with without word or any sign of progress. Resigned to chalking up this absence of outcome to an all too predictable lack of HBOS inertia in the face of any investigation, I am doubly disappointed to find the FOS, after admitting they miss handled and delayed the investigation into my HBOS compliant early last year, have once again reneged on their assurances to affect investigative compliance from this too big to fail 41% taxpayer owned bank by not insisting they respond to my accusations within the time frame specified.  It is my belief this lack of momentum only goes to prove, despite what the government, the bankers and their regulators would have us believe;
And, when it comes to providing a fair and efficient method by which the individual can seek restitution in the light of these findings,
  • The UK’s Financial Ombudsman Service is at best a shambles and at worst a complete sham.
Thomas Edison also said, “I have not failed, I have just found 10,000 ways which do not work” and despite a seemingly unproductive year which includes 44 blog post, 1538 tweets, 16,000 page views together with a fair amount of fruitless endeavours in the hands of the FOS, I remain hopeful I will not discover 10,000 ways which do not work for me before I finally achieve a much needed and long awaited way forward with HBOS.

Posts, Mail and Shots


Franklin D Roosevelt once said, “The test of our progress is not whether we add to the abundance of those who have much. It is whether we provide enough for those who have little” and while reports continue to illustrate the extent to which bankers avarice for their obscene levels of remuneration have infected and disabled moves towards regulatory change across the globe, I have embarked on a campaign to increase my readership in a bid to raise awareness of the impact their actions have had on the individual. With little more than a years experience as a writer and next to no knowledge of the Internet, social media sites or forums, this decision has taken me way beyond my comfort zone.

Over the past two weeks I have,

·        Signed up to, commented on and posted my blog on numerous articles relating to the economic recession.

·        Sent 562 tweets on my hitherto unused twitter account to a variety of recipients together with a link to my blog.

·        Applied to several different sites inviting writers to post pieces with a view to linking them to my blog

·        Explored Avatars, Gravatars, badges along with all things Google in order to improve the access to my blog

·        Posted new threads and links to my blog on Mumsnet in an effort to acquire information about the ongoing issues I have with HBOS.

Throughout this two week period, I have been filled with trepidation at the potential for abusive responses to my unsolicited “mail shot”.

I am delighted to be able to report the following.

I have,

·        Been invited to write a piece for Women Writers for September 2012

·        Acquired twenty one new and communicative followers on twitter

·        Heard from three separate individuals who are also suffering at the hands of HBOS

·        Tripled the number of people who have read my blog in previous months

·        Received three very supportive comments and expressions of encouragement with respect to my posts on Mumsnet

However, I have also received,

·        My first block, ever, from a former banker for “sending her spam”.

·        Had a post deleted from the Mumsnet legal section for inadvertently posting it where I should not have

And

·        Been subject to eight outraged and unsympathetic comments proclaiming my attitude to shortfall debt is naive, self indulgent and irresponsible.

Sincerely hoping the mood of these Mumsnet readers is not a reflection of the thinking woman or the public in general, this venomous outburst has left me wondering how I, and those like me, can hope to succeed in bringing about change in the attitude of the government, the financial regulators, and the banking elite if so many individuals are of the opinion the blame rests squarely with the very people who are struggling to keep their heads above water during this economic crisis, instead of the reckless and fraudulent risk-management strategies of the too big to fail banks who put them there.

English born American poet and dramatist W H Auden once said, “We are all here on earth to help others: what on earth the others are here for I don’t know” and after a week of this kind I can empathise with his viewpoint entirely.

Dark Knights and Hoods

Evangelist Billy Graham said, “There is nothing wrong with men possessing riches. The wrong comes when riches possess men” and hearing that former HBOS executive Peter Cumming’s corporate lending portfolio was something of an Aladdin’s cave, I can see how tantalising the promise of such riches must have been; especially to those who were ignorant of the fraudulent methods employed to achieve them. For those who agreed to practise the dark art of perpetuating “the get rich quick” myth on the balance sheets, I have no doubt the power that accompanied such lucrative returns was both all consuming and intoxicating.

Still victimised by the consequences of the ongoing banking gluttony, I often speculate as to how HBOS originally portrayed my own residential mortgage in April 2006 when an £790,000 advance was secured against my home based on what I now believe was a grossly inflated valuation of £925,000. It  has been no surprise to find HBOS' continued nonchalant attitude has persisted and precluded me from all discussions regarding this mortgage from the outset until the moment I contacted them about our financial circumstances in October 2008. Now I am even more curious to know how my unrecoverable £217,000 shortfall is being recorded in their loan book and explained considering it represents a nose dive of approximately 30% against their in house valuation only three years earlier and remains completely unrecoverable.

However, with all eyes currently on who will or won’t take a slice of the millions set aside for bankers bonuses this year and increasing public interest in who should be next to follow Fred Goodwin into his Knighthood free status, I cannot imagine anyone within HBOS or the FOS are wondering if the vast amount of HBOS debt that continues to be written off every day by Lloyds TSB might ever include a residential shortfall which has left me standing on a financial precipice for years. Nor do I delude myself any consideration by the FSA has been given as to whether or not my unrecoverable loan is still propping up HBOS balance sheets as a fictitious asset on which to pay executive bonuses or instead it is being used to perpetuate another boardroom driven myth that lurks in shady recesses supported by negative accountability for financial crimes against everyone but the HBOS executives themselves.

Forever presented with antidotes to our economic health which continue to favour the corporate along with solutions limited to toothless acts of regulation designed to placate rather than resolve, I cannot comprehend why, to date, no government initiative or banking reform has focused on a reprieve for the individual victims who, like me, remain in purgatory as a direct result of the well documented fraudulence, unadulterated greed and widespread corporate dishonesty of sociopathic CEOs, Banksters and their Hoods.

In the words of Abraham Lincoln, “We the people are the rightful masters of both Congress and the courts, not to overthrow the Constitution but to overthrow the men who pervert the Constitution” however, despite an economic crisis of global proportions, those who cruelly perverted the course of both my financial and family life, along with the lives of thousands of others like me, are not only at liberty to bully and persecute their victims without restraint but, thanks to David Cameron’s Christian principals of forgiveness and the captured policies of his regulators, they remain free to pervert any chance of a morally sound outcome for the individual.
