Talk and Tokenism


Winston Churchill once said, “However beautiful the strategy, you should occasionally look at the results” and as a long suffering victim of the ongoing banking crisis I wish those who chose to initiate the “pile it high” culture at the expense of the individual had seen fit to resist the opportunity to amass obscene personal wealth without moral regard, for fear of the wider economic consequences. 

Martin Wheatley would like us to believe flawed management run business models, policed by employees with a conflict of interest have been the major culprit when it comes to dangerously incentivised, inadequately trained banking staff miss-selling and miss-guiding financial customers. However, I struggle to comprehend how a culture favoring lucrative bonus structures for all those involved could be effectively implemented from anywhere but the very top. I suspect instead, it is at the giddiest of corporate heights, where the promise of multi million pound, profit linked remunerations which amount to hundreds of times the average salary that the greatest conflict to customer interest actually resides. As indicated by former HBOS director Peter Cummings, who now faces fines of £500,000 and a life time ban from the financial services industry for his part in the demise of HBOS, it is far more plausible that the decision to turn a blind eye to high risk strategies, product miss-selling and neglectful duty of care to clientele is made in the board room in front of sleepy regulators instead of residing in the domain of misguided sales staff or any single executive.

Following the FSA’s survey of twenty two financial institutions we are now assured the banks and their CEO’s are more than ready to embrace recommendations for an all encompassing change in operational culture. During the coming twelve months the new Financial Conduct Authority are entrusted to enforce and monitor these changes and Martin Wheatley insists this will mean banks will no longer be permitted to,
  •         Sell unsuitable products to people, especially the vulnerable
  •         Arrange the wrong mortgages because it costs people their homes
  •         Put their own interests and incentives ahead of their customers
  •        Employ business practices which are without integrity or unfair to customers


While I firmly believe Lloyds Banking Group (under whose skirts HBOS have hidden since 2008) will have an inordinate task ahead if Mr Wheatley’s guidelines are to be adhered to, if past performance remains a reasonable indicator of what to expect in the future, HBOS will find it nothing short of impossible because, over the last six years I know from personal experience they have,
  •  Paid out almost £4,000 in introducer fees my own mortgage despite there being no financial evidence to support the repayments    
  •  Overvalued our home to create the necessary headroom to facilitate the sale of their mortgage product
  • Refused to re-negotiate our mortgage terms or show any of the government promised forbearance when we got into trouble, despite my husband’s health problems 
  •  Omitted me from all discussions with regard to our mortgage, from outset, on the grounds it was my husband’s duty to keep me informed and not theirs
  •  Created a massive mortgage shortfall by unnecessarily forcing a sale when I had secured a method of servicing the loan via rental income


And,

  • Reputedly covered their own losses by placing “bets” against the property market in the knowledge their severely flawed lending portfolio was about to produce a massive downturn in property values.


 Aided and abetted by an all but a hands off attitude from both the regulators and the Financial Ombudsman Service, I am repeatedly advised that without proof of "intent", I will remain unable to recover losses caused by HBOS through legal channels as my damages are too remote. Nevertheless, it is my view the FSA’s findings that miss-sales were fueled by a strategy which employed irresponsible sales incentives is merely another example of cold blooded intent at the highest level.  HBOS profits were secured via the manipulation “with intent” of banking staff, manipulation “with intent” of the LIBOR rates and manipulation “with intent” of anything else which would provide a handsome return, regardless of the price paid by the individual and the global economy.

American president Franklin D Roosevelt once said, “In our personal ambitions we are individualists. But in our seeking for economic and political progress as a nation, we all go up or else all go down as one people” and in view of this, I can only hope Martin Wheatley successfully delivers his plan to address the “knock on effects to customers” of banking malpractice because some of us, as a direct result of our banks actions, are already at down at rock bottom.

And for us, there is nowhere else to go.

Dead and buried

Finding myself in something of a debt fighting lull as I await the Financial Ombudsman’s findings with regard to my complaint against HBOS, I have used the time to glean as much information as possible about HBOS's dealings to date. To my surprise, my HBOS Harassment page on face book has put me in contact with two other victims of Lloyds and HBOS skulduggery and I have been amazed to hear how much they too have suffered at the hands of this giant, too big to fail institution.

While greatly sympathising with their cases, I cannot pretend to have a full grasp of the detail. However, one thread of commonality runs throughout all. It appears no amount of communicating with HBOS or Lloyds has done anything to encourage these ivory towered bully-boys to either look objectively at what is being disputed nor embark on any remedial action for the sake of the individual.

It would seem HBOS has, for some time, had a reputation for steam rollering legal proceedings towards bankruptcy even when they are fully aware of people’s inability to pay. Reports revealing 8 out of 10 such cases should not ever have reached court in the first place do not appear to deter them and  HBOS are equally happy to bring proceedings to court for debts which are in dispute.  I understand from one lady I spoke to HBOS have attempted to repossess her home, through the courts, twenty two times.  Her dispute involves the Reading branch of HBOS where there is an ongoing police investigation which has resulted in several arrests for fraud.

Having already been taken to court to enable HBOS to obtain a possession order with which they beat through a fire sale on my home, I have been told, on more than one occasion, by Merrils Ede, their appointed solicitors, they plan to start legal proceedings towards bankruptcy because I am unable to pay the £217,000 shortfall that the HBOS instructed fire sale created. Like so many other victims of HBOS out there, it seems to be of no relevance this shortfall is in dispute and I am penniless anyway. Baring in mind how much it costs to action these proceedings I did not, until recently even begin to understand the thinking behind court cases of this nature.

However, I am now wondering if the reasoning behind a course of action such as this is simply an attempt by the individuals within HBOS to avoid losing face. I believe its quite possible I, together with all the other victims of HBOS who have disputes, have become an embarrassing legacy which needs to be dispatched, like cannon fodder, through the courts and then buried under an epitaph of “ bad debtors” in the balance sheets. I can only assume dealing with an individual’s dispute or unrecoverable debts in this way is less embarrassing to those at HBOS who have had a part in our creation and perhaps it is for this reason we have been ear marked for legal persecution. I cannot think what other reason there could be behind blindly spending taxpayers and share-holders money on cases which are doomed from the start to reap no reward.

Antonio Horta Osorio may well have asked his executives to bring out their dead but it is my belief  some of these very same people have in fact decided to bury us alive, on mass, in our trenches, without Antonio Horta Osorio ever knowing.

The Curse of the Strong

The Battle of the Banks has re-commenced today with the help of my loyal and talented letter writing friend, Chris. Despite outwardly embracing this conflict, I know in my heart of hearts, it takes a huge toll on my mental health. The price I usually pay for ignoring my overwhelming urge to either crawl under a stone or run for my life, is my hair loss, my sleep and my concentration.  Today is no exception and the first sign of the stress levels rising is a migraine which has already announced its imminent arrival.

Will power along with a chronic aversion to failure sees me through on days like this. However, it does me no favours.  Outwardly coping there is no indication the receipt of just one such letter has snatched the ground from beneath my feet.  Martin Lewis on the Jeremy Vine show referred to it as the ”Curse of the Strong”.  My decision to face these financial bullies, regardless of the cost to my health, is the only logical choice I have if I am intent on exposing the Bank of Scotland's abdication of all responsibilty for a shortfall their actions created . If I don't "stand and deliver" they will, yet again, get away with sweeping their dirty deeds under the carpet.

Today Merrils Ede’s henchwoman is in my firing line because she, with the Bank of Scotland’s blessing, is attempting to heap sufficient pressure on me to prompt an offer  of either a settlement or a payment arrangement. She is doing this by threatening bankruptcy proceedings again despite having financial eveidence which illustrates we are unable to do either. I have no doubt corresponding in this way also allows her an opportunity to rack up substantial ongoing fees.  It’s a “win win” situation as she stands to earn indefinitely from this unrecoverable debt, safe in the knowledge the Bank of Scotland will continue to pay her as long as she gives them the impression we are withholding payment rather than being, as the CAB have so plainly stated, completely without the means to make any offers.

These are the reasons Merrils Ede should not be wasting theirs and tax payers money chasing us at the Bank of Scotland’s behest and it is this information I intend to share with Ms Rottweiler's boss.
·        The case is in dispute and always has been from before the time Merrils Ede took it on two years ago

·        The CAB have repeatedly told her we have no surplus income or assets with which to offer a settlement and they have repeatedly provided Merrils Ede with evidence to this effect.

·        It is against FSA and OFT guidelines to make payment demands from people who have no means of making payments.

·        The Financial Ombudsman is investigating our case against the Bank of Scotland.

·        Because of our financial demise we are experiencing high levels of stress, as indicated in our doctor’s letters of which they have copies, and therefore our mental health is at risk.

     I suspect the Bank of Scotland appointed henchwoman from Merrils Ede has a personal dislike of people who, like me, are unable to pay their debts.  It wouldn’t surprise me if she has assumed high living and extravagance has been the reason for our shortfall and passed a personal judgement we deserve whatever postal punishment she decides to meter out. Whatever her motivation there is one fundamental principal she has yet to appreciate.

Outstanding accounts

As my husband arrived home earlier than unexpected today he found me sitting with a friend in our cosy farmhouse kitchen.  Being a very blustery day, we had chosen warm tea and M&S waste sale chocolate for our refreshment while injured seals were the topic of conversation. This comforting scene was achieved by exercising a well practiced mental manoeuvre which took me swiftly from debt fighting machine to comely housewife and mother in the blink of an eye and, by adopting this facade, I have managed to maintain the divide between our unpalatable past and our family’s future. 
My friend, equally chameleon like in her abilities, played her role of tea drinking companion to perfection as she packed away her computer while chatting about current affairs with my husband.  After a few minutes of pleasantries, she discreetly gathered up the post of the day and made her exit.  She, like my husband, understands the rules only too well.  The financial monster in the cupboard has been strictly out of bounds for him since October 2008.
The letters dispatched today are as consequence of my email being featured on BBC Radio 2.  Host Jeremy Vine was discussing debt related mental health issues with Martin Lewis who gasped when he heard my story.  The task in hand has been to attempt to contact Martin Lewis for help.
One of the many points which were made was even a relatively strong, financially aware person, such as myself, is unable to make suitable and informed decisions while suffering from stress.  The organisations whose livelihoods depend on the collection of debt, trade on this knowledge.  It is little wonder many people, including my husband, are driven to consider suicide because of the debt collecting companies campaigns of unrelenting harassment. In 2008 we were receiving upwards of thirty phone calls a day starting at 8.00am and finishing at 9.00pm. I always answered every one.
For six months my friend watched me attempt to deal with our insurmountable financial problems until April 2009, when, I finally agreed to accept her help.  By this time I had lost 35lbs and every hair on my body.
Today and every day since, my friend has freely given her time to fight my cause. We call it the “Crap Clinic” and we meet regularly to engage in the “Battle of the Banks”.  Because of her determined resolve at a time when I was emotionally on my knees, my £1,000,000 horror story has been reduced to a mere £350,000 nightmare.  Thankfully, she has agreed to see it through with me to the very end.  Without her selfless devotion, I would have undoubtedly collapsed under the pressure.
How can I ever repay her?
